📋 Agreement to These Terms

Welcome to VaidyaGuru — India's premier AI-powered Ayurveda educational platform, developed by D D Patel, BAMS Scholar at Government Ayurveda College Junagadh, Gujarat, India. By accessing or using VaidyaGuru at https://vaidya-guru.vercel.app — including all pages, features, the AI Tutor, digital book library, exam system, and study materials — you agree to be legally bound by these Terms of Service. If you do not agree to these terms, please stop using VaidyaGuru immediately. These Terms are governed by the laws of India, including the IT Act 2000, the DPDP Act 2023, and the Indian Contract Act 1872.

Eligibility & Account Registration

To create a registered account on VaidyaGuru, you must be at least 13 years of age. Users between 13 and 18 years of age may use VaidyaGuru for educational purposes with the knowledge and consent of a parent or legal guardian. By creating an account, you represent that you meet this age requirement.

When registering, you agree to provide accurate, complete, and current information about yourself. You are responsible for maintaining the accuracy of your account information and for keeping your account credentials secure. You must not share your account with another person or allow others to use your account.

Guest users (those not registered or logged in) may access certain features of VaidyaGuru (book library, MCQ practice, study materials) without creating an account. By using VaidyaGuru as a guest, you still agree to be bound by these Terms.

VaidyaGuru reserves the right to refuse registration, suspend, or terminate any account at its sole discretion — including for violation of these Terms, providing false information, or for any conduct that VaidyaGuru determines to be harmful to the platform or its community.

License to Use VaidyaGuru

Subject to your compliance with these Terms, VaidyaGuru grants you a limited, non-exclusive, non-transferable, revocable, personal license to access and use the VaidyaGuru platform solely for your own personal, non-commercial educational purposes.

This license permits you to:

This license expressly does not permit you to: copy, reproduce, distribute, publish, transmit, sell, license, or create derivative works from any VaidyaGuru content; scrape, crawl, or systematically download content from VaidyaGuru; use VaidyaGuru content for commercial purposes without written permission; or reverse engineer, decompile, or disassemble any part of the VaidyaGuru platform.

Prohibited Conduct

By using VaidyaGuru, you agree that you will not engage in any of the following prohibited activities:

Violations of these prohibitions may result in immediate account termination without notice and, where applicable laws are violated, may be reported to the appropriate authorities.

User-Uploaded Content

Certain features of VaidyaGuru allow authorized users (teachers and admins) to upload content — including study materials, MCQ exam questions, bulletin board notices, and images. For any content you upload to VaidyaGuru, you agree and warrant that:

By uploading content to VaidyaGuru, you grant VaidyaGuru a non-exclusive, royalty-free, worldwide license to display, distribute, and make available that content to VaidyaGuru users for educational purposes within the platform. This license ends when the content is removed from VaidyaGuru.

VaidyaGuru does not review all uploaded content before it is published. However, VaidyaGuru reserves the right to remove any user-uploaded content at any time, without notice, if it violates these Terms or is otherwise deemed inappropriate by VaidyaGuru's administrators.

⚠️ Content Responsibility

You are solely responsible for any content you upload to VaidyaGuru. VaidyaGuru expressly disclaims all liability for user-uploaded content. AI Tutor — Usage Rules & Limitations

VaidyaGuru's AI Tutor feature is powered by Google Gemini AI. By using the AI Tutor, you acknowledge and agree to the following:

VaidyaGuru reserves the right to review AI chat logs (in anonymized form) for the purposes of improving AI response quality and ensuring compliance with these Terms. We will not read individual users' chat content for commercial purposes.

Intellectual Property Rights

The VaidyaGuru platform — including its design, layout, branding, logo, custom UI components, original text content, original Gujarati/Hindi/English translations of classical texts, AI prompt engineering, feature architecture, and all original software code — is the intellectual property of VaidyaGuru (D D Patel) and is protected under applicable Indian intellectual property laws, including the Copyright Act 1957 and the Information Technology Act 2000.

The classical Ayurvedic texts (Charaka Samhita, Sushruta Samhita, Ashtanga Hridaya) are ancient works in the public domain. However, VaidyaGuru's specific translations, formatting, organization, and digital presentation of these texts represents original editorial work and is protected by copyright.

Nothing in these Terms grants you any right to use VaidyaGuru's name, logo, branding, or other proprietary marks without the prior written consent of VaidyaGuru.

✅ Fair Educational Use

You are permitted to take personal notes from VaidyaGuru content for your own study, quote brief passages for academic purposes with attribution, and share links to VaidyaGuru pages with fellow students. These uses are welcomed and encouraged as part of our educational mission.

Classical Samhita Content — Usage Restrictions

The digital Samhita content available on VaidyaGuru — including translations and commentary — is provided for personal educational study only. You agree not to:

No Medical Advice — Critical Clause

THIS IS ONE OF THE MOST IMPORTANT CLAUSES IN THESE TERMS. PLEASE READ IT CAREFULLY.

VaidyaGuru is a strictly educational platform. Nothing on VaidyaGuru — including AI responses, Samhita content, study materials, MCQ answers, bulletin board notices, or any other content — constitutes medical advice, clinical diagnosis, or treatment recommendation of any kind.

Specifically, you agree that:

VaidyaGuru expressly disclaims all liability for any health outcomes — whether positive or negative — resulting from any user's reliance on or use of VaidyaGuru content for clinical or health decision-making purposes.

⚠️ Medical Emergency Notice

If you are experiencing a medical emergency, please contact emergency medical services immediately. In India, dial 112 (National Emergency Number) or 102 (Ambulance). Do not use VaidyaGuru's AI Tutor or any other platform feature as a substitute for emergency medical assistance.

Account Suspension & Termination

VaidyaGuru reserves the right to suspend or permanently terminate your account and access to the platform at any time, with or without prior notice, for any of the following reasons:

You may terminate your own account at any time by using the Account Deletion option in Settings, or by contacting us at vaidyaguru.official.740@gmail.com. Upon account termination, your personal data will be deleted in accordance with our Privacy Policy.

Sections 6 (Intellectual Property), 8 (No Medical Advice), 12 (Limitation of Liability), 13 (Indemnification), and 14 (Governing Law) of these Terms shall survive termination of your account.

Disclaimer of Warranties

VaidyaGuru is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind — whether express, implied, or statutory. To the fullest extent permitted by applicable law, VaidyaGuru expressly disclaims all warranties, including but not limited to:

VaidyaGuru does not guarantee that the platform will be available at all times. We may occasionally take the platform offline for maintenance, updates, or due to factors outside our control (server outages, natural disasters, etc.).

Limitation of Liability

To the maximum extent permitted by applicable Indian law, VaidyaGuru, its founder D D Patel, its team, contributors, and affiliates shall not be liable to you for any:

VaidyaGuru's total cumulative liability to you for any claims arising from your use of the platform shall not exceed INR Zero (₹0) — reflecting that VaidyaGuru is a completely free service for which you have paid nothing.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, VaidyaGuru's liability shall be limited to the minimum extent required by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless VaidyaGuru, its founder D D Patel, team members, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

Governing Law & Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of India, including the Information Technology Act 2000, the Indian Contract Act 1872, the Consumer Protection Act 2019, and the Digital Personal Data Protection Act 2023, without regard to any conflict of law principles.

Jurisdiction: Any dispute arising out of or relating to these Terms or your use of VaidyaGuru shall be subject to the exclusive jurisdiction of the courts of Junagadh, Gujarat, India.

Informal Resolution First: Before initiating any formal legal proceeding, you agree to first contact VaidyaGuru at vaidyaguru.official.740@gmail.com and attempt to resolve the dispute informally. Both parties agree to make a genuine effort to resolve disputes amicably within 30 days of notification.

Arbitration: If informal resolution is unsuccessful, disputes may be resolved through binding arbitration in Junagadh, Gujarat, India, under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English or Gujarati. The arbitrator's decision shall be final and binding.

Modifications to These Terms

VaidyaGuru reserves the right to modify, update, or replace these Terms of Service at any time. Changes will be effective immediately upon posting the updated Terms to this page. The "Last Updated" date at the top of this page will reflect the date of the most recent revision.

For material changes that significantly affect your rights or obligations, we will make reasonable efforts to provide notice — such as displaying a notification within the VaidyaGuru app. Your continued use of VaidyaGuru after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using VaidyaGuru immediately.

We recommend that you periodically review these Terms and our Privacy Policy to stay informed of any changes.
