Terms of Service

To create a registered account on VaidyaGuru, you must be at least 13 years of age. Users between 13 and 18 years of age may use VaidyaGuru for educational purposes with the knowledge and consent of a parent or legal guardian. By creating an account, you represent that you meet this age requirement.

When registering, you agree to provide accurate, complete, and current information about yourself. You are responsible for maintaining the accuracy of your account information and for keeping your account credentials secure. You must not share your account with another person or allow others to use your account.

Guest users (those not registered or logged in) may access certain features of VaidyaGuru (book library, MCQ practice, study materials) without creating an account. By using VaidyaGuru as a guest, you still agree to be bound by these Terms.

VaidyaGuru reserves the right to refuse registration, suspend, or terminate any account at its sole discretion — including for violation of these Terms, providing false information, or for any conduct that VaidyaGuru determines to be harmful to the platform or its community.

Subject to your compliance with these Terms, VaidyaGuru grants you a limited, non-exclusive, non-transferable, revocable, personal license to access and use the VaidyaGuru platform solely for your own personal, non-commercial educational purposes.

This license permits you to:

• Read and study digital Samhita content available in the book library for personal educational use
• Use the AI Tutor for personal study and academic question-answering
• Practice MCQ exams for your own exam preparation
• Access study materials uploaded by teachers for your personal educational benefit
• Install VaidyaGuru as a PWA on your personal device for personal use

This license expressly does not permit you to: copy, reproduce, distribute, publish, transmit, sell, license, or create derivative works from any VaidyaGuru content; scrape, crawl, or systematically download content from VaidyaGuru; use VaidyaGuru content for commercial purposes without written permission; or reverse engineer, decompile, or disassemble any part of the VaidyaGuru platform.

By using VaidyaGuru, you agree that you will not engage in any of the following prohibited activities:

• Uploading, posting, or sharing any content that is false, misleading, defamatory, obscene, offensive, hateful, or violates any applicable Indian law
• Impersonating any person, Ayurvedic authority, institution, or organization
• Attempting to gain unauthorized access to any part of the VaidyaGuru platform, its servers, databases, or other users' accounts
• Using any automated tools (bots, scrapers, crawlers) to access or extract data from VaidyaGuru without written permission
• Uploading malware, viruses, or any code that could harm the platform or other users' devices
• Using VaidyaGuru's AI Tutor to generate content that is intended to deceive, defraud, or harm others
• Sharing login credentials or account access with others
• Engaging in any activity that places an unreasonable or disproportionate load on VaidyaGuru's infrastructure
• Violating any applicable local, state, national, or international law or regulation while using VaidyaGuru

Violations of these prohibitions may result in immediate account termination without notice and, where applicable laws are violated, may be reported to the appropriate authorities.

Certain features of VaidyaGuru allow authorized users (teachers and admins) to upload content — including study materials, MCQ exam questions, bulletin board notices, and images. For any content you upload to VaidyaGuru, you agree and warrant that:

• You own the content or have full legal right to upload and share it
• The content does not infringe any third party's copyright, trademark, privacy, or other intellectual property rights
• The content is accurate and does not contain false, misleading, or medically dangerous information
• The content does not violate any applicable Indian law or these Terms

By uploading content to VaidyaGuru, you grant VaidyaGuru a non-exclusive, royalty-free, worldwide license to display, distribute, and make available that content to VaidyaGuru users for educational purposes within the platform. This license ends when the content is removed from VaidyaGuru.

VaidyaGuru does not review all uploaded content before it is published. However, VaidyaGuru reserves the right to remove any user-uploaded content at any time, without notice, if it violates these Terms or is otherwise deemed inappropriate by VaidyaGuru's administrators.

VaidyaGuru's AI Tutor feature is powered by Google Gemini AI. By using the AI Tutor, you acknowledge and agree to the following:

• The AI Tutor is provided for educational and academic purposes only. You may not use it to generate content intended to deceive, defraud, harm, or mislead others.
• You may not attempt to "jailbreak," manipulate, or prompt the AI in ways intended to bypass its safety guidelines or produce prohibited content.
• AI responses are not medically reviewed or clinically validated. You must not rely on AI responses for any clinical decision-making, self-diagnosis, or self-treatment. See Section 8 (No Medical Advice).
• All AI chat sessions are stored in your account's Firestore data and are subject to our Privacy Policy. Do not share sensitive personal health information in the AI chat that you would not want stored.
• The AI's responses are also subject to Google's Terms of Service and Privacy Policy for the Gemini API.

VaidyaGuru reserves the right to review AI chat logs (in anonymized form) for the purposes of improving AI response quality and ensuring compliance with these Terms. We will not read individual users' chat content for commercial purposes.

The VaidyaGuru platform — including its design, layout, branding, logo, custom UI components, original text content, original Gujarati/Hindi/English translations of classical texts, AI prompt engineering, feature architecture, and all original software code — is the intellectual property of VaidyaGuru (D D Patel) and is protected under applicable Indian intellectual property laws, including the Copyright Act 1957 and the Information Technology Act 2000.

The classical Ayurvedic texts (Charaka Samhita, Sushruta Samhita, Ashtanga Hridaya) are ancient works in the public domain. However, VaidyaGuru's specific translations, formatting, organization, and digital presentation of these texts represents original editorial work and is protected by copyright.

Nothing in these Terms grants you any right to use VaidyaGuru's name, logo, branding, or other proprietary marks without the prior written consent of VaidyaGuru.

The digital Samhita content available on VaidyaGuru — including translations and commentary — is provided for personal educational study only. You agree not to:

• Copy and redistribute VaidyaGuru's translations commercially
• Reproduce substantial portions of VaidyaGuru's Samhita content on other websites or publications without written permission
• Use VaidyaGuru's Samhita content to create competing educational products or platforms

For academic citation or research use of Samhita content from VaidyaGuru, please contact us to discuss appropriate attribution and permissions.

THIS IS ONE OF THE MOST IMPORTANT CLAUSES IN THESE TERMS. PLEASE READ IT CAREFULLY.

VaidyaGuru is a strictly educational platform. Nothing on VaidyaGuru — including AI responses, Samhita content, study materials, MCQ answers, bulletin board notices, or any other content — constitutes medical advice, clinical diagnosis, or treatment recommendation of any kind.

Specifically, you agree that:

• You will not use VaidyaGuru content to self-diagnose any medical condition
• You will not use VaidyaGuru content to self-prescribe or self-administer any Ayurvedic treatment, herbal formulation, detoxification procedure (Panchakarma), dietary protocol, or any other health intervention without supervision from a qualified, licensed Ayurvedic doctor
• You will not delay seeking professional medical care for any health condition based on information obtained from VaidyaGuru
• You will not use VaidyaGuru as a substitute for consultation with a qualified healthcare professional

VaidyaGuru expressly disclaims all liability for any health outcomes — whether positive or negative — resulting from any user's reliance on or use of VaidyaGuru content for clinical or health decision-making purposes.

VaidyaGuru reserves the right to suspend or permanently terminate your account and access to the platform at any time, with or without prior notice, for any of the following reasons:

• Violation of any clause of these Terms of Service
• Uploading false, misleading, or medically dangerous content
• Abuse of the AI Tutor feature in ways that violate these Terms
• Any conduct that VaidyaGuru determines, in its sole discretion, to be harmful to the platform, other users, or the Ayurveda educational community
• Receipt of credible complaints from other users or authorities about your conduct on the platform
• Inactivity for a period of 24 or more months (in which case we may delete your data after prior notice)

You may terminate your own account at any time by using the Account Deletion option in Settings, or by contacting us at vaidyaguru.official.740@gmail.com. Upon account termination, your personal data will be deleted in accordance with our Privacy Policy.

Sections 6 (Intellectual Property), 8 (No Medical Advice), 12 (Limitation of Liability), 13 (Indemnification), and 14 (Governing Law) of these Terms shall survive termination of your account.

VaidyaGuru is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind — whether express, implied, or statutory. To the fullest extent permitted by applicable law, VaidyaGuru expressly disclaims all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the platform will be uninterrupted, error-free, or completely secure
• Warranties regarding the accuracy, completeness, reliability, or currentness of any content on the platform — including AI responses, Samhita translations, and study materials
• Warranties that the platform will meet your specific educational, professional, or personal requirements

VaidyaGuru does not guarantee that the platform will be available at all times. We may occasionally take the platform offline for maintenance, updates, or due to factors outside our control (server outages, natural disasters, etc.).

To the maximum extent permitted by applicable Indian law, VaidyaGuru, its founder D D Patel, its team, contributors, and affiliates shall not be liable to you for any:

• Indirect, incidental, consequential, special, or punitive damages of any kind
• Loss of data, profits, revenue, business, or goodwill
• Physical, mental, or financial harm resulting from reliance on educational content, AI responses, or any other platform content
• Harm resulting from unauthorized access to your account or data arising from factors outside VaidyaGuru's direct control
• Damages arising from your inability to access or use the platform at any time

VaidyaGuru's total cumulative liability to you for any claims arising from your use of the platform shall not exceed INR Zero (₹0) — reflecting that VaidyaGuru is a completely free service for which you have paid nothing.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, VaidyaGuru's liability shall be limited to the minimum extent required by applicable law.

You agree to indemnify, defend, and hold harmless VaidyaGuru, its founder D D Patel, team members, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of VaidyaGuru or any content you access through it
• Your violation of any provision of these Terms of Service
• Any content you upload to VaidyaGuru that infringes any third-party rights
• Your violation of any applicable law or regulation while using VaidyaGuru
• Any claim by a third party arising from your conduct on VaidyaGuru

These Terms of Service shall be governed by and construed in accordance with the laws of India, including the Information Technology Act 2000, the Indian Contract Act 1872, the Consumer Protection Act 2019, and the Digital Personal Data Protection Act 2023, without regard to any conflict of law principles.

Jurisdiction: Any dispute arising out of or relating to these Terms or your use of VaidyaGuru shall be subject to the exclusive jurisdiction of the courts of Junagadh, Gujarat, India.

Informal Resolution First: Before initiating any formal legal proceeding, you agree to first contact VaidyaGuru at vaidyaguru.official.740@gmail.com and attempt to resolve the dispute informally. Both parties agree to make a genuine effort to resolve disputes amicably within 30 days of notification.

Arbitration: If informal resolution is unsuccessful, disputes may be resolved through binding arbitration in Junagadh, Gujarat, India, under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English or Gujarati. The arbitrator's decision shall be final and binding.

VaidyaGuru reserves the right to modify, update, or replace these Terms of Service at any time. Changes will be effective immediately upon posting the updated Terms to this page. The "Last Updated" date at the top of this page will reflect the date of the most recent revision.

For material changes that significantly affect your rights or obligations, we will make reasonable efforts to provide notice — such as displaying a notification within the VaidyaGuru app. Your continued use of VaidyaGuru after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using VaidyaGuru immediately.

We recommend that you periodically review these Terms and our Privacy Policy to stay informed of any changes.
